Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.
The case originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face alien smuggling charges, he was held in immigration detention.
In her order, the judge noted that the government does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
